These writ petitions are filed praying to declare that the demand for contribution of Rs. 2.00 Lakhs per acre towards Cauvery Water Supply Scheme and the Ring Road surcharge at Rs. 1.00 lakh per acre, are without authority of law and etc.,
These writ petitions coming on for hearing this day, the Court made the following:-
O R D E R
Learned counsel for the petitioners states that the petitioners have challenged the levy of Cauvery Water Supply III Stage contribution ( at the rate of Rs. 2.00 lakhs per acre ) and Ring Road surcharge ( Rs. 1.00 lakh per acre ) in these petitions.
Subsequent to the filling of the petitions the BDA Act, 1976, has been amended and such amendments have a bearing on these matters. The petitioners therefore request permission to with draw these petitions and file comprehensive petitions challenging the provisions of the Amended Act.
Accordingly, these petitions
are dismissed reserving liberty tot he petitioners to file comprehensive petitions.
