Promulgated by the
Governor of Karnataka in the Forty-fourth year of the Republic of India and first
published in the Karnataka Gazette Extraordinary on the sixteenth day of June. 1993.
An ordinance further to amend the
Bangalore Development Authority Act, 1976 .
Whereas both the Houses of the State Legislature are not in Session and the
Governor of Karnataka is satisfied the circumstances exist which render it necessary for
him to take immediate action further to amend the Bangalore Development Authority Act.
1976 (Karnataka Act 12 of 1976) for the purposes here in after appearing;
Now,
therefore, in exercise of the powers conferred by clause (1) of Article 213 of the
Constitution of India the Governor of Karnataka is pleased to promulgate the following
Ordinance, namely:-
(1) Short
title and commencement:- This Ordinance may be called the Bangalore Development
Authority (Amendment) Ordinance, 1993. [2] It shall come in to force at once.
(2) Amendment
of Section 2:- In Section 2 of the Bangalore Development Authority Act 1976(Karnataka
Act 12 of 1976 ) (hereinafter referred to as the principal Act),
(i) after
clause (d) the following shall be inserted, namely:-
(da) Bonafide Member
means a member of the Scheduled Society determined by the Committee constituted under
sub-section (2) of Section 37C,
(ii) after clause (p)
the following shall be inserted, namely:-
(pa) Schedule means
schedule appended to this Act,
(pb) Scheduled Property means
any land specified in Schedule A [Mentioned Below]
which is acquired by the State Government for and on behalf of any Scheduled Society.
(pc) Scheduled Society means a
House Building Co-operative Society specified in the Schedule B [Mentioned Below]
(3) Amendment
of Section 10:- In Section 10 of the principal act, in sub-section (2),
(i) for the
words does not exceed fifty lakhs of rupees, the words does not exceed
such amount as may be specified by the Government, from time to time shall be
substituted;
(ii) for the words
exceeds fifty lakhs of rupees the words exceeds the amount so
specified shall be substituted.
(4) Insertion
of new Sections 37A, 37B, and 37C, :- After Section 37 of the principal Act, the
following new sections shall be inserted, namely :-
37A. The Authority to receive
the Scheduled Property for development purposes:- Notwithstanding anything contained in
this Act or rules or regulations or bye-laws made there under, the Authority shall receive
the Scheduled property specified in Schedule A [Mentioned
Below] from the Scheduled Society or the Government for development purposes and
distribution of sites to the bonafide members.
37B. Authority to develop
Scheduled Property:- (1) After the Authority has received the Scheduled Property under
section 37A the Authority shall determine the cost of execution of development work land
formation of extension or lay out and require the Scheduled Society or its members, as the
case may be, to pay such cost to the Authority as
may be specified by the Authority:
Provided
that where a member of the Scheduled Society has already paid the amount for execution of
the development work or extension of layout in respect of the Scheduled Property, to the
Scheduled Society, the amount so paid shall be taken into account and deducted while
fixing such cost and the same may be paid by the Scheduled Society to the Authority:
Provided further that where the Scheduled Society has already paid the amount to
the Authority for execution of development work and formation of extension or layout in
respect of the Scheduled Property, the amount so paid shall be taken into account while
determining such costs under sub-section (1)
(2)
On payment of the amount determined under sub-section (1), the
Authority shall execute the development work and formation of extension or layout in
respect of the Scheduled Property.
37C.
Allotment of sites by the Authority:- (1) Notwithstanding any thing in this Act or in any
other law for the time being in force, after formation of extension or layout, the
Authority shall allot sites to bonafide members of the Scheduled Society in such manner
and subject to such conditions, restriction and limitations as may be specified therein.
(2) The Government
shall, by notification, constitute a committee consisting of such persons as may be
specified therein, for the purpose of identifying the bonafide member.
(5) Insertion of Scheduled:- After Section 77 of the principal Act
the following Schedules shall be inserted, namely:-
