Gist of Frauds
1. Layout Plan is not approved
2. 2600 sale deeds of sites are Registered fraudulently
3. Civic amenities sites are converted into 500 sites and are allotted to
Judges of High Court, Supreme Court and Lower Courts, and spouses of
ministers.
4. Neighboring lands of 37 acres are grabbed by fraudulent and illegal Court
Decrees or by muscle power and coercion
5. Without (A. conversion of lands from Agricultural use to Residential use
sites
5. B. Without sale deeds from land owners the society claiming to be as owner
has formed sites and registered the same.
5. C. Without the layout plan approval; all by fraud decree of court.
6. Society has not fulfilled the conditions/ liabilities arising out of the
resolution passed by BDA in November 92 based upon which Society claims BDA has
approved layout plan and has registered 2600 sites.
7. As per law and the judgment procured by the by the society; society has
not executed Relinquishment Deed; relinquishing 50 % of lands free of cost in
favor of BDA.
8. Members of society which includes High Court and Supreme Court judges do
not have confidence in High Court of Karnataka; as the WP claims that most of
the sitting judges are beneficiaries of sites illegally; hence they prefer
Supreme Court.
9. CMC, Yelankha without authority of law has illegally opened Khathas on
sites.
10. Indirectly what the WP No.40994 of 2002 says and admits is that the high court of
Karnataka has illegally approved loan applications to construct houses in the
controversial layout or financing companies have illegally financed the members
of the society.
11. Further what is admitted is that whole layout formed claiming to be in
156 acres in 1992 now grown to 193 acres extended like elastic, sites formed
thereon, sale deeds executed thereof, khatas opened by CMC, loans taken to
purchase sites or construction are all illegal.
12. The WP No.40994 of 2002 wants to demolish about 500 sites or constructions thereon and
handover this land to BDA as relinquishment deed.
